Your content on our services

Some of our services allow you to upload, store, send or receive content. You retain ownership of any intellectual property rights you hold over that content. In a few years, what belongs to you is still yours.

When you upload, store, submit, or receive content to or through our Services, you grant BBMax.Online (and those with whom we work) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations, or other changes we make to make your content work better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license have the limited purpose of operating, promoting and improving our Services and developing new ones. This license continues even if you stop using our Services. Some Services may provide ways to access and remove content that has been provided to this Service. In addition, on some of our services, there are terms or settings that restrict the scope of our use of the content submitted on these Services. Please be sure to have the necessary rights to grant us this license for any content you submit to our Services.

4. Non-transferable
   Your right to use the BBMax.Online Platform, as well as username and password is a personal and non-transferable right.
5. Links to other sites
   The Site and the Services may contain links to other sites. We are not responsible for the content, accuracy or opinions expressed on such websites and such sites are not investigated, monitored or verified as to the accuracy or completeness by us. The inclusion of any linked site on our website pages and services does not imply the approval or endorsement of the site linked to us. If you decide to access these third-party websites, you do so at your own risk
6. Errors, corrections and changes We
   may make changes to the features, functionalities or content of the Site and BBMax.Online at any time. We reserve the right at our discretion to edit or delete any documents, information or other content from the site
7. Applicable Law

The forum of the District of Rio de Janeiro, State of Rio de Janeiro, is elected as the sole authority to annul any disputes arising from this document, regardless of any other privileged matter whatsoever or will be

8. RULES FOR FREELANCERS

• You can't request or share contact details when submitting a proposal, question, or in project chat without it being required as part of the project or without the customer requesting it.
• Payments cannot be requested or accepted from outside the platform..
• Offensive content cannot be sent to another user.
• You have to do the agreed work.
• The agreed deadline must be met.
• You can't commit any or d'or.

 

9. RULES FOR CUSTOMER

• You can't share contact data when submitting a proposal, question, or in project chat without it being needed as part of the project.
• Payments cannot be made outside the platform.
• Offensive content cannot be sent to another user.
• Unpaid tests cannot be requested.

 

10. SANCTIONS

Breaking the above rules, spreading spam, fraud, creating fake projects, illegal activities and any other practices that do not comply with the terms and rules of use, will be subject to the following penalties:

• Penalty

The penalty penalty blocks user activities, such as publishing projects and submitting proposals, for the period set by the platform administration.

• Ban

The ban sanction permanently terminates user access on the platform, including other accounts of the same user.

Even if banned, the Freelancer user can receive payment for the project executed, informing the platform. The transfer of payment will be subject to the rules contained in these Terms of Use.

 

11. COSTS FOR CUSTOMERS

There are no costs for registration, publication of projects and visualization of candidates.

Depending on the payment method chosen, the fees and interest charged by the means of payment themselves may be charged.

FOR FREELANCERS

There are no costs for user registration and submission of proposals. We add a fee of 10% to 20% (R$ 5.00 minimum) in your offer sent to the Customer (the fee is about the final amount).

 

12.FLUXO DE PROJETOS ANÁLISE E APROVAÇÃO

Submetido um projeto pelo Cliente, ele será direcionado para a análise da plataforma, antes da publicação.

A BBMax  poderá editar o conteúdo do projeto, sem alterar a sua natureza, em caso de erros ortográficos, links inválidos, informações incoerentes ou fora das regras da plataforma.

Também serão omitidas do projeto informações de contato (número de telefone, endereço, links externos, etc) e valores previamente estipulados pelo Cliente.

Na análise do projeto, serão considerados reprovados aqueles que estiverem em desacordo com as políticas da plataforma. Especialmente se contiverem:

• Projetos duplicados – Publicações públicas idênticas ou quase idênticas em um curto intervalo de tempo
• Vagas de emprego – A plataforma é destinada a serviços autônomos
• Inappropriate Content – Information containing pornography, violence, discrimination or any conflict with legal provisions
• Indefinite or incomplete project - The Client does not make clear the conditions of the project or no longer fill sinformation essential for the receipt of proposals
• Advertisements
• Unpaid projects, commission-remunerated on the result or exchange
• Academic papers

After the project, it will become available for Freelancers to launch their proposals.

The Client will be able to select the Freelancer that best suit their needs to execute the project.

When selecting freelancer, you must make the payment for the stipulated amount. The amount will be under the custody of the platform until the completion or cancellation of the project.

 

13. CONCLUSION

After the execution of the work, the Freelancer must mark the project as completed and it will be forwarded for release of the payment by the Client.

The Customer will have up to 5 (five) business days to release the payment or request changes to the work performed by Freelancer.

After the said period and there is no manifestation of the Client, the platform will verify that the work has been completed by Freelancer and release the payment.

 

14. CLOSED DESIGN

After the deadline for receiving the proposals, if the Client does not select any Freelancers, the project is closed.

The Customer may, at its discretion, terminate the project before the chosen deadline as well as before making the payment guarantee, without the incidence of any penalty.

 

15. TRANSFERS

After the release of the payment to Freelancer, either by the platform or by the Client, the amount cannot be refunded.

The transfer of payment to Freelancer will comply with the following deadlines: up to

15 (fifteen) business days

The deadlines indicated will start after the delivery of the project or, for partial deliveries and extended deadlines, after payment by the Client or the platform.

Freelancer must pre-register the bank account for receipt and ensure the accuracy of the reported data.

If the bank details entered are incorrect, the deadline will be interrupted and restarted only after the correction.

 

16. FRAUD PREVENTION POLICY

Before passing on the payment, BBMax may review the project to verify that there is no suspicion of fraud.

If the suspicion, the platform will ask the user for documentation proving the veracity of the negotiation.

Payment will be blocked indefinitely until the requested documents are sent.

 

17. DISPUTE

If the Client requests the cancellation of the project after the payment guarantee and after the Freelancer starts the designated work, the platform will open a dispute between the participants.

Once the dispute is open, the parties may voluntarily designate the other as the winner.

Taking place on the part of the Client (designating the Freelancer as the winner), the payment will be passed on to freelancer.

Taking place on the part of Freelancer, the payment guarantee will be returned to the Client.

The dispute will be dealt with directly by the moderators if the parties request it or if there is no interaction between the disputers during the dispute.

The judging committee will review the dispute and decide, according to the following criteria, the winner of the dispute.

Criteria used:

• Project scope
• Freelancer's Proposal
• Communications and agreements between the Client and Freelancer preferably made in the chat of the platform.

The parties may be asked by BBMax for additional documents confirming the execution or not of the project.

The definition of the dispute will depend on the complexity of the project and the collaboration of the parties in resolving the dispute.

• O Freelancer descumpriu o escopo determinado pelo Cliente
• O Freelancer descumpriu o prazo por ele estipulado
• O Freelancer plagiou conteúdo

A disputa será decidida a favor do Freelancer quando:

• Freelancer comply with the scope determined by the Client and comply with the agreed deadline

The dispute will be ended with the partial transfer to the freelancer when:

• The Client requests the cancellation of the work before the deadline and after the freelancer has already started the project.
• The Moderation understand that Freelancer has complied with the scope but there are minor improvements / modifications to be made.

If the Client does not respond to Freelancer's requests for clarification and sending information necessary for the execution of the project, the deadline for compliance of freelancer will be extended to the same extent.

If the Client accepts the delivery of the freelancer after the agreed deadline, the previous deadline will be disregarded.

 

18. REIMBURSEMENT

The refund, if applicable, will be made, preferably by the means of payment themselves and will include the fees paid for the use of financial services (the refund will be total).

In the impossibility of making the refund by means of payment, this will be carried out by means of a bank transfer, subtracted from the amount of the fees retained by the means of payment

In this case, the transfer can only be made in the account indicated by the Client and its ownership.

The platform has up to 7 (seven) business days to process the refund request made by the Customer.

If the refund is made through the means of payment, BBMax's partner providers will process the request and make the refund within their own time.

• If the refund is made via bank transfer, the platform will have up to 7 (seven) business days to execute the transfer.
• The request for reimbursement made by the Customer directly by the credit card company will imply the penalties provided for in the following item.
• If the card operator appreplises the Customer's request and makes the refund, the platform is not responsible for the payment to Freelancer, and the latter must seek with the Client the necessary means to receive the payment for the service performed.
• Refunds of the amounts paid for subscriptions to the "Pro" and "Premium" plans must be requested within seven (7) calendar days.
• It is not possible to refund the fees paid for the reopening of the project and the acquisition of optional (Urgent and Highlight).

BBMax provides tax documents relating to the services actually provided by the platform.
